2.2 Purchasing Services

• We buy used IBC tanks from businesses and individuals
• Bulk purchasing programs for commercial customers
• On-site pickup services within our service area
• Fair market value assessments for your used containers

2.3 Reconditioning Services

• Professional cleaning and sanitization
• Pressure testing and leak detection
• Valve and fitting replacement
• Cage repair and replacement
• Label removal and documentation

2.4 Recycling Services

• Environmentally responsible disposal of end-of-life tanks
• Material separation and recycling
• Documentation for regulatory compliance
• Certificates of destruction when required

3.1 Account Creation

Certain features of our Services may require you to create an account or provide personal and business information. When creating an account or submitting information, you agree to provide accurate, current, and complete information and to update such information as necessary to maintain its accuracy.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring that you log out of your account at the end of each session

3.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. You may also request account deletion by contacting our customer service team.

4.1 Product Information

We strive to provide accurate descriptions, specifications, and images of our products. However, we do not warrant that product descriptions, pricing, or other content is accurate, complete, reliable, current, or error-free. Used and reconditioned tanks may vary in appearance from images shown and may exhibit signs of prior use consistent with their described condition.

4.2 Product Conditions

Our products are categorized as follows:

• New: Factory-sealed tanks with full manufacturer warranty
• Reconditioned: Professionally cleaned, inspected, and restored to meet or exceed industry standards; may include new valves, gaskets, and labels
• Used - Grade A: Clean, structurally sound tanks with minimal cosmetic wear
• Used - Grade B: Functional tanks with moderate wear; suitable for non-critical applications
• Used - Grade C: Tanks sold as-is for repair, parts, or recycling purposes

4.3 Pricing

All prices are quoted in United States Dollars (USD) unless otherwise specified. Prices are subject to change without notice. The following pricing policies apply:

• Quoted prices are valid for thirty (30) days from the date of quotation unless otherwise stated
• Prices do not include applicable taxes, shipping, handling, or delivery fees unless expressly stated
• Volume discounts may be available for bulk orders; contact us for custom pricing
• We reserve the right to correct pricing errors even after an order has been placed

5.1 Order Placement

Orders may be placed through our website, by phone, by email, or in person at our facility. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraudulent activity.

5.2 Order Confirmation

Upon placing an order, you will receive an order confirmation email or document. This confirmation acknowledges receipt of your order but does not constitute acceptance. An order is not accepted until we process payment and provide shipping confirmation or pickup scheduling.

5.3 Accepted Payment Methods

We accept the following forms of payment:

• Cash (for in-person transactions)
• Company or personal checks (subject to verification)
• Major credit cards (Visa, MasterCard, American Express, Discover)
• Wire transfers for orders over $5,000
• Net terms for approved business accounts

5.4 Payment Terms

• Payment is due at time of pickup or prior to delivery unless credit terms have been established
• For approved business accounts, payment is due Net 30 unless otherwise specified
• Orders placed on credit are subject to credit approval and limit availability
• Deposits may be required for custom orders, large orders, or orders from new customers

5.5 Late Payments and Fees

• Returned checks will incur a fee of $35.00
• Late payments on credit accounts will incur interest at 1.5% per month (18% annually)
• Accounts past due by 60 days or more may be referred to collections
• Customer is responsible for all costs associated with collection, including attorney fees

6.1 Shipping Methods

We offer multiple shipping and delivery options:

• Customer Pickup: Available at our Baltimore facility during business hours
• Local Delivery: Within the Baltimore metropolitan area using our fleet
• Regional Delivery: MD, VA, PA, DE, and DC via our trucks or carrier partners
• Nationwide Shipping: Via LTL freight carriers for customers outside our delivery area

6.2 Shipping Costs

Shipping costs are calculated based on destination, order weight, dimensions, and selected shipping method. Shipping costs will be quoted at the time of order and must be paid in full before shipment. Free delivery may be available for qualifying orders within our local delivery area.

6.3 Delivery Times

Estimated delivery times are provided for planning purposes only and are not guaranteed. Delivery times may vary based on product availability, destination, weather conditions, and carrier schedules. We are not liable for delays in delivery caused by circumstances beyond our control.

6.4 Title and Risk of Loss

Title to products and risk of loss passes to you upon delivery to the carrier or, for customer pickups, upon loading at our facility. For local deliveries using our trucks, title and risk passes upon delivery to the specified delivery address.

6.5 Delivery Requirements

• Customer must provide accurate delivery address and contact information
• Delivery location must be accessible by standard delivery vehicles
• Customer is responsible for having appropriate equipment to unload if not otherwise arranged
• Signature may be required upon delivery
• Redelivery fees may apply if delivery cannot be completed due to customer unavailability

7.1 General Return Policy

We want you to be satisfied with your purchase. If you are not completely satisfied, you may return eligible products within thirty (30) days of delivery, subject to the terms and conditions outlined below.

7.2 Eligibility for Returns

To be eligible for a return, the following conditions must be met:

• Products must be in original, unused condition
• Products must not have been filled, used, or modified in any way
• All original packaging, labels, and accessories must be included
• Return must be initiated within 30 days of delivery
• Customer must obtain a Return Merchandise Authorization (RMA) number before returning

7.3 Non-Returnable Items

The following items cannot be returned:

• Used or reconditioned tanks that have been filled or used after purchase
• Custom orders or specially manufactured items
• Products sold “as-is” or for parts/recycling purposes
• Hazardous material containers that have been used
• Products damaged due to customer misuse, negligence, or improper storage
• Products returned without authorization

7.4 Return Process

1. Contact our customer service team to request an RMA number
2. Provide your order number, product details, and reason for return
3. Receive RMA number and return shipping instructions
4. Pack products securely to prevent damage during transit
5. Ship products to our facility with RMA number clearly marked
6. Refund will be processed upon receipt and inspection of returned items

7.5 Return Shipping

Customer is responsible for return shipping costs unless the return is due to our error (wrong item shipped, defective product, or product significantly not as described). We recommend using a trackable shipping method and purchasing shipping insurance for your protection.

7.6 Restocking Fees

Restocking fees may apply to certain returns:

• Standard returns: 15% restocking fee
• Returns after 30 days (if approved): 25% restocking fee
• Large quantity returns: restocking fee negotiated on a case-by-case basis
• No restocking fee for returns due to our error

7.7 Refunds

Refunds will be processed as follows:

• Refunds are issued to the original payment method
• Credit card refunds typically appear within 5-10 business days
• Check refunds are issued within 10 business days of approval
• Original shipping charges are non-refundable unless return is due to our error
• Restocking fees and applicable charges will be deducted from refund amount

7.8 Exchanges

We are happy to exchange products for a different item of equal or greater value. Price differences and additional shipping costs for exchanges are the customer's responsibility. Exchange requests follow the same timeline and conditions as returns.

8.1 New Product Warranty

New IBC tanks are sold with the manufacturer's original warranty, which typically covers defects in materials and workmanship. Warranty terms vary by manufacturer and product type. We will provide warranty documentation upon request and assist with warranty claims when applicable.

8.2 Reconditioned Product Warranty

Reconditioned IBC tanks come with a Baltimore IBC Tanks limited warranty:

• 90-day warranty against leaks and valve failures under normal use conditions
• Warranty covers replacement or repair at our discretion
• Warranty does not cover damage from misuse, overfilling, incompatible contents, or improper storage
• Warranty claims must be accompanied by photos and description of the issue

8.3 Used Product Warranty

Used IBC tanks (Grades A, B, and C) are sold “as described” with no warranty unless otherwise specified in writing. We thoroughly inspect all used products before sale and accurately describe their condition, but used products may have inherent limitations based on their prior use and age.

8.4 Warranty Exclusions

Warranties do not cover:

• Damage resulting from accidents, misuse, or abuse
• Use with incompatible or prohibited materials
• Modifications or repairs made by unauthorized parties
• Normal wear and tear
• Damage from exposure to extreme temperatures or conditions beyond product specifications
• Cosmetic damage that does not affect functionality

9.1 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BALTIMORE IBC TANKS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) OUR SERVICES OR PRODUCTS.

9.2 Maximum Liability

Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the greater of (a) the amount you paid to us for the specific product or service giving rise to the claim in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).

9.3 Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, OUR SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.4 Product Use Disclaimer

You acknowledge that you are solely responsible for determining the suitability of our products for your intended use. We are not liable for any damages, injuries, or losses resulting from the use of our products for purposes other than those for which they were designed or for use with incompatible materials.

10.1 Our Intellectual Property

The Baltimore IBC Tanks name, logo, website content, graphics, images, and all related trademarks, service marks, and trade dress are the property of Baltimore IBC Tanks or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, modify, or distribute any of our intellectual property without our prior written consent.

10.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our website for personal or internal business purposes related to purchasing our products and services. This license does not include the right to collect or use information from our website for commercial purposes, use automated systems to access our website, or create derivative works from our content.

11.1 Product-Related Prohibitions

• Use our products for storing illegal substances or materials
• Use food-grade tanks for non-food materials without proper reconditioning
• Store materials incompatible with the tank specifications
• Modify tanks in ways that compromise their structural integrity or safety
• Remove or alter safety labels, warnings, or manufacturer markings
• Resell our products as new when they are reconditioned or used

11.2 Website-Related Prohibitions

• Attempt to gain unauthorized access to our systems or networks
• Use automated scripts or bots to access our website
• Interfere with or disrupt our website or servers
• Transmit viruses, malware, or other harmful code
• Harvest or collect user information without consent
• Impersonate another person or entity

12.1 Informal Resolution

Before initiating any formal dispute resolution proceedings, you agree to first attempt to resolve any dispute informally by contacting us at info@baltimore-ibc-tanks.com. We will attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within thirty (30) days of submission, either party may proceed with formal dispute resolution.

12.2 Mediation

If informal resolution is unsuccessful, the parties agree to attempt mediation before pursuing arbitration or litigation. Mediation shall be conducted by a mutually agreed-upon mediator in Baltimore, Maryland. The costs of mediation shall be shared equally between the parties.

12.3 Arbitration

If mediation is unsuccessful, any remaining dispute shall be resolved by binding arbitration conducted by a single arbitrator in Baltimore, Maryland, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

12.4 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in any class action lawsuit or class-wide arbitration against Baltimore IBC Tanks.

13.1 Applicable Law

These Terms and any dispute arising out of or related to these Terms or our Services shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions.

13.2 Jurisdiction

Subject to the dispute resolution provisions above, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Baltimore City, Maryland, for any actions not subject to arbitration.

14.1 Right to Modify

We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. We will provide notice of material changes by posting the updated Terms on our website and updating the “Last updated” date at the top of this page.

14.2 Notification of Changes

For significant changes, we may also provide additional notice, such as sending an email to account holders or displaying a prominent notice on our website. It is your responsibility to review these Terms periodically for changes.

17.1 Complete Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published by us on our website, constitute the entire agreement between you and Baltimore IBC Tanks regarding your use of our Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter hereof.

17.2 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Baltimore IBC Tanks.

17.3 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may assign or transfer these Terms, in whole or in part, without restriction.
